Article 1 - Champ d’application

1. Le présent règlement s’applique, quelle que soit la nature de la juridiction, aux matières civiles relatives :
a) au divorce, à la séparation de corps et à l’annulation du mariage des époux ;
b) à l’attribution, à l’exercice, à la délégation, au retrait total ou partiel de la responsabilité parentale.

Article 63 - Traités conclus avec le Saint-Siège

(modifié par Règl. 2116/2004 du Conseil du 2 décembre 2004)

1. Le présent règlement est applicable sans préjudice du traité international (concordat) conclu entre le Saint-Siège et le Portugal, signé au Vatican le 7 mai 1940.
2. Toute décision relative à l’invalidité d’un mariage rendue en vertu du traité visé au paragraphe 1 est reconnue dans les États membres dans les conditions prévues au chapitre III, section 1.
3. Les dispositions des paragraphes 1 et 2 s’appliquent également aux traités internationaux (concordats) ci-après conclus avec le Saint-Siège :
a) "Concordato lateranense" du 11 février 1929 entre l’Italie et le Saint-Siège, modifié par l’accord, et son protocole additionnel, signé à Rome le 18 février 1984 ;
b) accord du 3 janvier 1979 entre le Saint-Siège et l’Espagne sur des questions juridiques.
c) accord entre le Saint-Siège et Malte sur la reconnaissance d’effets civils aux mariages canoniques et aux décisions rendues par les autorités et juridictions ecclésiastiques sur lesdits mariages du 3 février 1993, y compris le protocole d’application de la même date, et son deuxième protocole additionnel du 6 janvier 1995.
4. En Espagne, en Italie ou à Malte, la reconnaissance des décisions prévue au paragraphe 2 peut être soumise aux mêmes procédures et contrôles que ceux qui sont applicables aux décisions rendues par les juridictions ecclésiastiques conformément aux traités internationaux conclus avec le Saint-Siège et visés au paragraphe 3.
5. Les États membres communiquent à la Commission :
a) une copie des traités visés aux paragraphes 1 et 3 ;
b) toute dénonciation ou modification de ces traités.

(a) divorce, legal separation or marriage annulment ;
(b) the attribution, exercise, delegation, restriction or termination of parental responsibility.

Article 63 - Treaties with the Holy See

(amended by Council Regulation No 2116/2004 of 2 December 2004)

1. This Regulation shall apply without prejudice to the International Treaty (Concordat) between the Holy See and Portugal, signed at the Vatican City on 7 May 1940.
2. Any decision as to the invalidity of a marriage taken under the Treaty referred to in paragraph 1 shall be recognised in the Member States on the conditions laid down in Chapter III, Section 1.
3. The provisions laid down in paragraphs 1 and 2 shall also apply to the following international treaties (Concordats) with the Holy See :
(a) ‘Concordato lateranense’ of 11 February 1929 between Italy and the Holy See, modified by the agreement, with additional Protocol signed in Rome on 18 February 1984 ;
(b) Agreement between the Holy See and Spain on legal affairs of 3 January 1979 ;
(c) Agreement between the Holy See and Malta on the recognition of civil effects to canonical marriages and to decisions of ecclesiastical authorities and tribunals on those marriages of 3 February 1993, including the Protocol of application of the same date, with the second Additional Protocol of 6 January 1995.
4. Recognition of the decisions provided for in paragraph 2 may, in Spain, Italy or Malta, be subject to the same procedures and the same checks as are applicable to decisions of the ecclesiastical courts handed down in accordance with the international treaties concluded with the Holy See referred to in paragraph 3.
5. Member States shall send to the Commission :
(a) a copy of the Treaties referred to in paragraphs 1 and 3 ;
(b) any denunciations of or amendments to those Treaties.
